People may argue the statistics, but more than 80% of my high school classmates were divorced from their first spouse within 20 years. The odds are that YOUR marriage won’t last.
The reality is that people who marry are in love and often think their relationship will last for life, but it doesn’t. Of course, many marriages happen because there is a pregnant girl and a “shotgun wedding.” These are even more likely to end quickly.
However, the next big point is that at least in English speaking countries, pre-nuptial property settlements will not be enforced by a court in a divorce unless they are “fair to both parties.”
What that means is that a judge will decide who gets what, regardless of any agreements between the parties. The standard courtroom order is to divide all “marital property” 50/50 and to give the family home and custody of the kids, to the woman —along with substantial alimony and child support payments.
The happy divorced lady then finds out that she, along with over 80% of all divorced women, never collect on the court support awards because the ex-husband skips out or claims he can’t pay because he is no longer gainfully employed.
Both parties may have great expectations but most marriages end in acrimony. Maybe one in ten marriages are reasonably happy and long lasting. Bad odds!
From my point of view, MARRIAGE is the first step towards a divorce. It puts the state into bed with you. It’s a huge disadvantage to the wealthier partner in any marriage —with or without a pre-nuptial agreement.
